IA sem fronteiras | Os riscos ocultos no fluxo internacional de dados pessoais

A popularização de plataformas de inteligência artificial generativa, como o ChatGPT e o DeepSeek, ampliou o debate sobre os riscos associados à transferência internacional de dados pessoais de titulares brasileiros.

No artigo publicado no JOTA, nossa sócia Beatriz Costa, em coautoria com Daniel Dore Lage, analisa os desafios regulatórios do tema aplicados à IA Generativa, à luz da Lei Geral de Proteção de Dados (LGPD) e do cenário geopolítico atual.

A análise destaca que, independentemente da origem do modelo de inteligência artificial, a maioria das plataformas de IA em operação no Brasil não atende integralmente aos critérios de transparência exigidos pela LGPD — incluindo a ausência de informações claras sobre os mecanismos legais de transferência e os países de destino dos dados.

The popularization of generative artificial intelligence platforms, such as ChatGPT and DeepSeek, has intensified the debate around the risks associated with the international transfer of personal data from Brazilian data subjects.

In an article published by JOTA, our partner Beatriz Costa, in coauthorship with Daniel Dore Lage, analyzes the regulatory challenges posed by generative AI, in light of Brazil’s General Data Protection Law (LGPD) and the current geopolitical landscape.

The analysis highlights that, regardless of the origin of the AI model, most platforms operating in Brazil do not fully comply with the transparency requirements established by the LGPD — including the lack of clear information about legal transfer mechanisms and the destination countries of the data.
